Tom NorrisSenior Associate

Tom Norris is a Senior Associate with Resolve Litigation Lawyers with a special interest in regulatory investigations, compliance, competition and consumer law and insolvency. He previously worked with PricewaterhouseCoopers Legal where he gained experience in Commercial Litigation, Corporate Law and Employment Law.

Tom has had the carriage of major disputes in the Supreme Court of New South Wales, the Court of Appeal of New South Wales and the Federal Court of Australia and has provided advice across a broad range of industries including banking and finance, manufacturing and retail, energy and resources, telecommunications and IT and pharmaceuticals and healthcare.

Tom has represented clients in a range of commercial disputes involving regulatory issues, contractual disputes, corporation law disputes, insurance, intellectual property, professional negligence, directors’ duties, insolvency issues, franchise dispute, shareholder disputes and employment and industrial relations.

Tom has represented clients in regulatory investigations including:

  • acting for the employees of a number of domestic and international banks in connection with various international regulatory investigations, including appearing at regulatory examinations;
  • acting for former directors of multinational companies in relation to investigations by ASIC, including in relation to insolvent trading and fraud;
  • acting for the employee of a domestic bank in connection with an ACCC investigation into foreign currency manipulation;
  • acting for respondents to s155 ACCC notices;
  • providing advice in relation to insider trading claims; and
  • providing advice in relation to an investigation by the Independent Commission Against Corruption.

Tom has had extensive experience in conducting regulatory compliance audits, including:

  • acting for Iron Mountain Inc. to provide a number of audit reports pursuant to a section 87B divestiture undertaking to the ACCC in relation to the divestiture of assets connected with an authorisation of an acquisition;
  • acting for Telstra and NBN Co to provide a number of compliance reports in connection with a section 87B structural separation undertaking to the ACCC;
  • acting for Electronic Arts Inc, EA Swiss Sarl and Electronic Arts Pty Limited to provide compliance reports pursuant to a section 87B undertaking to the ACCC in relation to the Australian Consumer Law;
  • acting for a multinational designer, developer and seller of consumer electronics, computer software, online services and personal computers to provide compliance reports pursuant to a section 87B undertaking to the ACCC in relation to the Australian Consumer Law;
  • acting for Gotalk Limited to provide compliance reports pursuant to a section 87B undertaking to the ACCC in relation to the Australian Consumer Law; and
  • acting for Oticon Australia to provide a series of audit reports pursuant to section 87B undertaking to the ACCC in relation to resale price maintenance.

Competition and consumer law work undertaken by Tom includes:

  • acting for numerous clients in matters which have involved allegations of breaches of the Competition and Consumer Act 2010 (Cth) and the Trade Practices Act 1974 (Cth) including in the Supreme Court of NSW, the NSW Court of Appeal and the Federal Court of Australia;
  • providing competition advice, including in relation to whether a proposed acquisition will substantially lessen competition in that market;

Tom has had extensive insolvency experience, including:

  • defending former directors of multinational companies against claims by voluntary administrators, receivers and liquidators, including appearing at regulatory and liquidators’ examinations;
  • acting for companies and individuals in insolvency law proceedings in the Supreme Court of NSW and the Federal Court of Australia, including enforcing and setting aside statutory demands, commencing and defending winding-up proceedings and commencing and defending bankruptcy proceedings;
  • acting in unfair preference actions; and
  • acting for KordaMentha in a preliminary discovery application in the Supreme Court of New South Wales.

  • conducting investigations into the conduct of a former CEO for breaching his employment agreement;
  • acting for a multinational energy company in a dispute with former directors of its Australian subsidiary including successfully defending a claim in the Fair Work Commission; and
  • providing advice in relation to termination of employees, including senior management.
