Claudia Dela CruzAssociate

Claudia Dela Cruz is an Associate with Resolve Litigation Lawyers.  She was admitted as a solicitor in New South Wales in July 2016.

In addition to her Master of International Law from the University of Sydney and her accreditation as a lawyer in Australia, Claudia has a law degree from the University of Münster, Germany.  Claudia is fluent in English, German and Spanish.

Claudia is also a board member of the German-Australian-Pacific Lawyers Association, where she organises and presents at conferences and seminars.

Claudia has had a key role in a range of commercial disputes and regulatory investigations. Her experience includes acting for clients in proceedings in the Supreme Court of NSW and the Federal Court of Australia as well as representing clients in Public Inquiries and investigations by the Australian Securities and Investments Commission.

Expertise

Claudia has represented clients in a range of commercial disputes, including:

  • acting for and advising a multi-national business in relation to contractual disputes and debt recovery;
  • advising European companies and clients in relation to contractual disputes in Australia;
  • providing advice about shareholder disputes, misleading or deceptive conduct and insurance disputes;
  • acting for property developers in proceedings in the Supreme Court of NSW in relation to a claim for compensation; and
  • acting for an applicant in proceedings in the NSW Civil and Administrative Tribunal in relation to a strata dispute.

Claudia’s regulatory investigations and compliance experience includes:

  • acting for a former director of a national company during an ASIC investigation in relation to insider trading;
  • acting for a director of a stockbroking firm at proceedings before ASIC under section 920A of the Corporations Act 2001 regarding an investigation into contraventions of financial services law;
  • acting for two individuals in the Public Inquiry into RSL NSW under the Charitable Fundraising Act 1991;
  • acting for a government contractor in relation to an investigation into a government department regarding expenditure and governance; and
  • assisting in preparing an independent compliance audit report for a section 87b undertaking provided to the Australian Competition and Consumer Commission by two national telecommunication companies.

  • acting for an incorporated association in an employment dispute with its chief executive officer, including proceedings in the Fair Work Commission;
  • advising an executive in relation to an employment dispute with the NSW Government; and
  • acting for an employee in unfair dismissal proceedings in the Fair Work Commission.
