Claudia Dela Cruz is an Associate with Resolve Litigation Lawyers.

Claudia has acted in a range of commercial disputes, regulatory investigations and media claims. Her experience includes acting for clients in proceedings in the Supreme Court of New South Wales and the Federal Court of Australia as well as representing clients in public inquiries and investigations by the Australian Securities and Investments Commission (ASIC) and other regulatory bodies.

Claudia holds a Master of International Law from the University of Sydney and has a law degree from the University of Münster, Germany.  Claudia is fluent in English, German and Spanish.

Claudia is board member of the German-Australian-Pacific Lawyers Association, where she organises and presents at conferences and seminars. She is an active member of the German-Australian Chamber of Industry and Commerce (AHK Australia) and the Spanish-Australian Chamber of Commerce (La Cámara).

Claudia has acted for a number of European clients, including a renowned German brewery and an Italian fashion company.

Claudia has acted in a number of commercial disputes for clients in proceedings in the Federal Court of Australia, the Supreme Court of New South Wales, the District Court of New South Wales, the Local Court of New South Wales and the NSW Civil and Administrative Tribunal.

Claudia also has acted for and advised clients in commercial disputes concerning commercial contracts, shareholder disputes, Australian Consumer Law claims, insurance disputes, debt recovery and strata scheme disputes.

Claudia’s work in litigation and dispute resolution includes:

  • acting for and advising a multinational business in relation to a number of contractual disputes and debt recovery matters;
  • representing a German brewery in proceedings in the Supreme Court of New South Wales concerning a dispute with its distributor in Australia;
  • advising an Italian fashion company with respect to a commercial contract with an Australian distributor;
  • advising an Austrian client in respect of enforcement of a mortgage;
  • acting for shareholders in a commercial dispute with the company and other shareholders;
  • advising clients in relation to claims pursuant to the Australian Consumer Law, including misleading or deceptive conduct claims;
  • acting for property developers in proceedings in the Supreme Court of New South Wales in relation to a claim for compensation;
  • providing advice to clients in relation to insurance claims; and
  • representing an applicant in proceedings in the NSW Civil and Administrative Tribunal in relation to a strata schemes dispute.

Claudia has represented clients in relation to ASIC investigations, ASIC show cause hearings, public inquiries, investigations into government agencies and inquiries by professional disciplinary boards across a wide range of industries. Claudia has also acted as an independent auditor in relation to companies’ compliance with section 87B undertakings provided under the Australian Consumer Law.

Claudia’s regulatory investigation and compliance experience includes:

  • acting for a director of a stockbroking firm in an ASIC show cause hearing concerning a banning order for contraventions of financial services law;
  • representing a director of a national sports company in an ASIC investigation into insider trading;
  • acting for two individuals in the Public Inquiry into RSL NSW under the Charitable Fundraising Act 1991 (NSW);
  • representing for a government contractor in relation to an investigation into a government agency regarding expenditure and governance;
  • acting for a surgeon in relation to investigations into professional misconduct by several disciplinary boards; and
  • acting as the independent compliance auditor in relation to a section 87B undertaking provided by two national telecommunication companies under the Australian Consumer Law.

Claudia has acted for plaintiffs and defendants in defamation disputes and proceedings in the Supreme Court of New South Wales and the District Court of New South Wales, including:

  • representing a plaintiff in defamation proceedings against an international media company in the Supreme Court of New South Wales;
  • acting for a plaintiff in relation to a defamation claim against a Sydney school; and
  • representing a defendant in defamation proceedings in the Supreme Court of New South Wales and the District Court of New South Wales.
